Term and Conditions of Transport
INSTRUCTION
CPL INTER-LOGISTICS CO., LTD. (CPL) SHALL BE HANDLING, WAREHOUSING, PACKING, TRANSPORTING, AND/OR SHIPPING YOUR CARGO WITH OUR BEST CARE.YOU AS A CONSIGNEE AND CONSIGNOR ALLOW CPL INTER-LOGISTICS CO., LTD. TO INSPECT ALL COMMODITIES AND SHIP YOUR CARGO WITH ANY CARRIER SELECTED BY US TO DESTINATION AND WILL NOT ABANDON OR REFUSE TO RECEIVE THE CARGO WHEN THEY ARRIVE AT THE DESTINATION; IF SO, YOU WILL BE FULLY RESPONSIBLE FOR ALL CHARGES OCCURING AT DESTINATION.
PACKING AND WAREHOUSING
ONCE YOU AGREED TO SHIP WITH US, WE WOULD PROVIDE ONE MONTH FREE OF CHARGE FOR THE PRODUCT WAREHOUSING AND WOULD BE RESPONSIBLE FOR ANY LOSS OR DAMAGE OCCURRING TO ANY PRODUCT UNDER OUR CUSTODY DURING THIS PERIOD.FOR ANY PRODUCT LEFT OVER ONE MONTH PERIOD SHALL BE CHARGED FOR A RATE OF 300 BAHT PER MONTH PER CUBIC METER MININUM 100 THB PER SHIPMENT PER MONTH AND THE GUARANTEES FOR LOSS AND DAMAGE SHALL BE VALIDATED AUTOMATICALLY ONCE YOU AGREE TO PAY FOR THE WAREHOUSING CHARGE. THE WAREHOUSING CHARGE SHALL BE WAIVED IN THE CASE PROVIDED WITH OR WITHOUT THE GURANTEES PROVIDED.INCASE IF ANY PRODUCT LEFT OVER ONE MONTH PERIOD AND YOU REFUSE TO PAY FOR WAREHOUSING CHARGE OR ANY OTHER SERVICE CHARGE OCCURRED FOR OVER 60 DAYS, YOU AGREE NOT TO RECEIVE THE CARGO AND THE OWNERSHIP OF THE PRODUCT SHALL BE TRANSFERRED TO US. CPL HAS THE RIGHT TO DESTROY OR SELL IN ORDER TO GET RETURN BACK MONEY TO PAY FOR OUTSTANDING SERVICE CHARGE.IF YOU USE OUR PACKING SERIVCE OR USE ANY FREIGHT SERVICE INCLUDING PACKING SERVICE, WITH THE MINIMUM OF 4 DAYS PACKING AND INSPECTING PERIOD FROM THE LAST COMMODITY CORRECTION DATE, YOUR COMMODITIES SHIPPED WITH US SHALL BE CAREFULLY PACKED AND THOROUGHLY INSPECTED BEFORE LEAVING OUR WAREHOUSE.
NAME AND ADDRESS CORRECTIONS:
PLEASE MAKE SURE THAT YOUR ADDRESSIS COMPLETE AND SPELLED CORRECTLY. IF YOU HAVE AN APARTMENT OR SUITE NUMBER, IT MUST BE INCLUDED.IF AN ADDRESSIS INCORRECT AND MERCHANDISE RETURNED BECAUSE OF THIS, YOU ARE RESPONSIBLE FOR ALL SHIPPING COSTS ASSOCIATED WITH THE ORDER.IF AFTER REVIEWING A CONFIRMATION YOU FIND THAT SOMETHING ISNOT CORRECT, YOU MUST NOTIFY US IMMEDIATELY. IF THE SHIPMENT STILL IN OUR WAREHOUSE, THE CHANGE CAN BE DONE WITHOUT ANY CHARGE. IF THE ITEM HAS LEFT THE WAREHOUSE, YOU WILL BE CHARGED A MINIMUM OF $20.00FOR THE CONSIGNEE NAMEANDADDRESS CORRECTION.DESTROY ORRETURN SHIPMENT BY CUSTOMS ORDERINCASE THE SHIPMENT IS NOT PASSED THE CUSTOMS CLEARANCE EITHER IN ORIGINAL COUNTRY OR DESTINATION COUNTRY AND SHIPMENT NEED TO BE DESTROYED OR RETURNED BACK TO THE ORIGINAL ADDRESS, YOU WILL BE RESPONSIBLE FOR ALL CHARGE OCCURRED.
LOSS OR DAMAGE:
IF YOU USE OUR PACKING SERIVCE OR USE ANY FREIGHT SERVICE INCLUDING PACKING SERVICE, YOUR COMMODITIES SHIPPED WITH US WAS CAREFULLY PACKED AND THOROUGHLY INSPECTED BEFORE LEAVING OUR WAREHOUSE. RESPONSIBILITY FOR ITS SAFE DELIVERY WAS ASSUMED BY THE CARRIER UPON ACCEPTANCE OF THE SHIPMENT. CLAIMS FOR LOSS OR DAMAGE SUSTAINED IN TRANSIT MUST, THEREFORE, BE MADE UPON THE CARRIER AS FOLLOWS:
CONCEALED LOSS OR DAMAGE:
CONCEALED LOSS OR DAMAGE MEANS LOSS OR DAMAGE WHICH DOES NOT BECOME APPARENT UNTIL THE COMMODITIES HAVE BEEN UNPACKED. THE CONTENTS MAY BE DAMAGED IN TRANSIT DUE TO ROUGH HANDLING EVEN THOUGH THE CARTON MAY NOT SHOW EXTREME DAMAGE. WHEN THE DAMAGE IS DISCOVERED UPON UNPACKING, FILE A CLAIM WITHIN 3 (THREE) DAYS FROM DELIVERY DATE.
VISIBLE LOSS OR DAMAGE:
ANY EXTERNAL EVIDENCE OF LOSS OR DAMAGE MUST BE NOTED ON THE FREIGHT BILL OR EXPRESS RECEIPT, AND SIGNED BY THE CARRIER’S AGENT. FAILURE TO ADEQUATELY DESCRIBE SUCH EXTERNAL EVIDENCE OF LOSS OR DAMAGE MAY RESULT IN THE CARRIER REFUSING TO HONOR A DAMAGE CLAIM. THE FORM REQUIRED TO FILE SUCH A CLAIM WILL BE SUPPLIED BY THE CARRIER.THE LOSS OR DAMAGE OF ANY SHIPMENT PACKED AND INSPECTED BY US BEFORE LEAVING OUR WAREHOUSE AND PROVED BY THE CARRIER THAT THE LOSS OCCURS BEFORE LEAVING OUR WAREHOUSE OR THE DAMAGE IS DUE TO THE ROUGH PACKAGING SHALL BE RESPONSIBLE BY US. THE CLAIM SHALL BE MADE TO YOU EITHER BY CASH OR BANK TRANSFER ACCORDING TO THE REAL VALUE OF THE LOSS OR DAMAGE MERCHANDISED BUT SHALL NOT BE OVER THE SUM OF ALL CHARGES PAID TO US.
CLAIM FOR LOSS OR DAMAGE
WHEN YOU UNPACKED AND FOUND THE LOSS OR DAMAGE, YOU WILL NEED TO NOTIFY US AND REQUEST FOR CLAIM FORM. YOU WILL NEED TO FILL THE FORM AND SEND THEM BACK WITH THE PROOF OF LOSS OR DAMAGE IN FORM OUR PICTURE OF VIDEO CLIP WITHIN THE TIME FRAME. CPL SHALL DO INVESTIGATION AND INFORM THE CLAIM RESULT WITHIN 21 (TWENTY-ONE) BUSINESS DAYS.
RESERVE THE RIGHT TO CLAIM
IF THE PACKING SERVICE DOES NOT PERFORMED BY CPL, WE RESERVE THE RIGHT NOT TO CLAIM FOR ANY DAMAGE OCCURRED DUE TO THE ROUGH PACKAGING.WE RESERVE THE RIGHT NOT TO CLAIM FOR ANY DAMAGE DUE TO PRODUCT ITSELF SUCH AS BREAKABLE, PULISHABLE ETC.YOU WILL HAVE TO FILE A CLIAM WITHIN 3 DAYS AFTER RECEIVING THE CARGO, IF NOT, WE RESERVE THE RIGHT NOT TO CLAIM FOR SUCH LOSS OR DAMAGE OCCURRED.WE RESERVE THE RIGHT NOT TO CLAIM FOR ANY DELAY FOR ANY SHIPMENT EXCEPT FROM THE SIHPMENT WITH DELIVERY TIME GUARANTEE.
INSURANCE
SHIPMENT WITH HIGH VALUE, WE RECOMMEND YOU TO BUY INSURANCE TO COVER THE LOSS OR DAMAGE. THE INSURANCE PREMIUM IS 2% OF INSURANCE COVERAGE FOR SERVICE EXCLUDING IMPORT DUTY AND TAX OR 5% OF INSURANCE COVERAGE FOR SERVICE INCLUDING IMPORT DUTY AND TAX. SHIPMENT WITH INSURANCE, CONPENSATION SHALL BE MADE PER ACTUAL LOSS OR DAMAGE IN FULL AMOUNT COVERAGE.
DELAY, LOSS OR DAMAGE DUE TO FORCE MAJEURE
WE RESERVE THE RIGHT NOT TO BE RESPONSIBLE FOR ANY DELAY, LOSS OR DAMAGE DUE TO FORCE MAJEURE SUCH AS EARTHQUAKE, FLOODED, BOAT CAPSIZE, PLANE CRASH, WAR, PORTEST, EPIDEMIC INCLUDING ACTION OR OMISSION OF TAX AUTHORITIES OR RELEVANT GOVERNMENT UNIT WHICH ARE BEYOND OUR CONTROL.
PROHIBITED OR ILLEGAL PRODUCTS FOUND
IF ANY PROHIBITED OR ILLEGAL PRODUCTS FOUND IN YOUR SHIPMENT CAUSING PROBLEM TO OUR OTHER SHIPMENTS, YOU HAVE TO BE RESPONSIBLE FOR ALL PANALTY AND FINE.
RETURN SHIPMENT BY CUSTOMER ORDER
IF YOU REQUEST US TO RETURN ANY ITEM, ORDER OR SHIPMENT BACK TO SENDER/SELLER, YOU WILL NEED TO REQUEST RETURN LABEL FROM SELLER (IF ANY). WE SHALL HAVE SERVICE CHARGE FOR 200 THB PER CARTON EXCLUDING DELIVERY CHARGE AS PER ACTUAL COST.
